Agreement to terms

By accessing or using HeyPochi ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the service. We may update these terms from time to time; continued use after changes constitutes acceptance.

Description of service

HeyPochi lets you create and share pages for your pets. You can add photos, bios, and other content, and share a link to your pet's page. Some features may require an account. We strive to keep the service available but do not guarantee uninterrupted access.

Accounts and eligibility

You must be at least 13 years old to use HeyPochi. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information when signing up. We may suspend or terminate accounts that violate these terms or for other reasons we deem appropriate.

Your content and conduct

You retain ownership of the content you post (e.g. photos, text). By posting, you grant us a license to use, store, display, and distribute that content as needed to operate and improve the service. You agree that your content and conduct will not:

• Violate any law or infringe others' rights (including intellectual property or privacy)
• Be defamatory, harassing, hateful, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation
• Introduce malware, spam, or interfere with the service or other users

We may remove content or suspend accounts that we believe violate these terms or our policies, without prior notice.

Public pages and sharing

Pet pages you make public can be viewed by anyone with the link. Do not post content you do not want to be public. We are not responsible for how others use or share content that you choose to make public.

Intellectual property

HeyPochi and its branding, design, and technology are owned by us or our licensors. You may not copy, modify, or create derivative works of our service or use our trademarks without permission. Feedback you provide may be used by us without obligation to you.

Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, secure, or uninterrupted. We are not liable for any content posted by users or for actions taken by third parties.

Limitation of liability

To the fullest extent permitted by law, HeyPochi and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the service. Our total liability shall not exceed the amount you paid us, if any, in the twelve months before the claim, or one hundred dollars, whichever is greater.

Indemnification

You agree to indemnify and hold harmless HeyPochi and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your content, or your violation of these terms or any law.

Termination

You may stop using the service at any time. We may suspend or terminate your access with or without notice. Upon termination, your right to use the service ends. Provisions that by their nature should survive (e.g. disclaimers, limitation of liability, indemnification) will survive.

General

These terms constitute the entire agreement between you and HeyPochi regarding the service. If any part is held invalid, the rest remains in effect. Our failure to enforce a right does not waive it. These terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
